2. Services Overview
Digital Rodeo provides digital marketing services, including audits, strategy, implementation, ongoing optimization, consulting, and related customer support, as described on our website and in any written engagement materials.
3. Use of Website and Services
Eligibility
You must be at least 18 years old and legally able to enter contracts to use our services. By using our services you affirm that you meet these requirements.
Permitted use
You may not:
- Provide false or misleading information
- Impersonate any person or entity
- Interfere with or disrupt the site or services
- Attempt unauthorized access to our systems
- Use our services for any illegal or fraudulent purpose
4. Quotes, Estimates, and Engagements
Non-binding estimates. Initial pricing and scopes shared during discovery are preliminary and subject to verification and mutual written agreement.
Verification. We reserve the right to verify information you provide; final pricing and scope may be adjusted based on actual conditions discovered during assessment.
No obligation. Acceptance is voluntary. You are under no obligation to accept any proposal.
5. Disclaimers and Limitations
No guarantees
While we work hard to produce results, we do not guarantee specific outcomes, rankings, lead volumes, revenue, or uninterrupted access to the website.
“As is” service
Our services are provided on an “as is” and “as available” basis without warranties of any kind, express or implied, including merchantability and fitness for a particular purpose.
Limitation of liability
To the maximum extent permitted by law, Digital Rodeo will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services, even if advised of the possibility.
6. Intellectual Property
All website content — text, graphics, logos, images, software — is owned by Digital Rodeo or its licensors and is protected by copyright and trademark law. Reproduction without our express written permission is prohibited.
7. Privacy
Your use of our services is also governed by our Privacy Policy. By using our services you consent to the collection and use of your information as described there.
8. SMS / Text Messaging Terms
A2P messaging compliance
Digital Rodeo complies with Application-to-Person (A2P) messaging regulations, including the TCPA, CAN-SPAM Act, and current U.S. carrier requirements.
Consent requirements
Providing a phone number and checking the relevant consent box on our forms constitutes your express written consent to receive text messages from Digital Rodeo. Transactional and marketing consents are tracked separately. Marketing consent is optional and is not a condition of using our services.
Message types
- Transactional — appointment confirmations, call reminders, project updates, document requests, customer support, and account notices.
- Marketing — promotions, special offers, educational content, and product updates (opt-in only).
Message frequency
- Transactional: variable, typically 2–10 per active project milestone.
- Marketing: up to 4 per month, if you have opted in.
Message and data rates
Standard message and data rates may apply. You are responsible for any carrier charges associated with messages we send.
Supported carriers
SMS is supported on major U.S. carriers (AT&T, T-Mobile, Verizon, and others). Carriers are not liable for delayed or undelivered messages.
How to opt out (STOP)
You may opt out at any time by:
- Replying STOP, END, QUIT, CANCEL, or UNSUBSCRIBE to any message

We will send one confirmation message after you opt out. Messages already in transit may still be delivered briefly. Opting out of marketing does not opt you out of transactional messages relating to an active engagement.

Privacy and data sharing
Your SMS consent and phone number are not shared with third parties for their marketing purposes. We share phone numbers only with SMS service providers and carriers strictly to deliver the messages you have consented to. See our Privacy Policy for details.
Consent revocation and re-consent
You may revoke consent using any of the opt-out methods above. To resume messages after opting out, submit a new consent through our forms, contact us directly, or reply START or UNSTOP.
Changes to phone number
You are responsible for notifying us promptly if your phone number changes so we do not send messages to a number you no longer own.
SMS service warranties
We do not guarantee that messages will be delivered without delay, delivered at all, free of errors, or compatible with every device. SMS services are provided “as is” and we are not liable for failures or delays outside our reasonable control, including carrier issues.
Compliance updates
We monitor SMS regulations and may update our messaging practices and these terms accordingly.
9. Third-Party Services
Our site and services may integrate with third-party tools. We are not responsible for their actions, content, or policies.
10. Indemnification
You agree to indemnify and hold harmless Digital Rodeo, its owners, employees, and agents from any claims, damages, losses, or expenses arising from your use of our services or your violation of these Terms.
11. Modification of Terms
We may modify these Terms at any time. Changes take effect when posted. Your continued use of the site or services after changes are posted constitutes acceptance.
12. Termination
We may suspend or terminate access to our site or services at any time, with or without cause or notice.
13. Governing Law
These Terms are governed by the laws of the State of Oklahoma, without regard to conflict-of-law principles.
14. Dispute Resolution
Any dispute arising under these Terms will be resolved through binding arbitration under the rules of the American Arbitration Association, conducted in Tulsa, Oklahoma.
15. Severability
If any provision of these Terms is found unenforceable, it will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force.
16. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Digital Rodeo regarding your use of our site and services.
